Abstract

This research aims to study the services of telecom companies in the United Arab Emirates. This study will be a jurisprudential analytical study by stating its cases and its jurisprudential adaptation by appending it to its analogues in Islamic jurisprudence to know its legal ruling. The importance of studying the services of telecom companies is evident as they relate to financial transactions that are indispensable for a member of society. It was very important to clarify what is permissible and forbidden to be a Muslim aware of his command. The study relied on the inductive approach to collect the services provided by telecom companies to individuals and institutions, and what relates to it the terms and conditions by searching in the companies' website, their promotional messages, and studies written about their services, and the analytical approach to show the picture and issues of the service related to it, clarify its pillars and conditions, studying it to reach the idiosyncratic conditioning for it. Among the most prominent results of the research is that the services of telecom companies are due in their jurisprudential adaptation to the contracts of leasing and selling. However, the basic principle is that it is permissible except for a condition or description attached to the contract, which is out of the original. The researcher recommends establishing a Sharia committee to look into the services provided by telecommunications companies and clarify what is permissible from it to be permissible and enforced and what is forbidden from it to be prevented or amended to conform to the provisions of Islamic law.
