    Practice of zakah distribution of MAIWP : an analytical juristic study

    Majlis Agama Islam Wilayah Persekutuan (Islamic Religious Council of the Federal Territory) collected RM823.579 million zakah in 2021 and distributed 90 percent of it. This is one of the highest zakah collection rates among State Islamic Religious Councils in Malaysia, and it is evidence of the efficiency of zakah management by MAIWP. Even though there have been several studies about MAIWP in the past, studies about MAIWP’s zakah management from a fiqh perspective are in short supply. Therefore, there is a need to examine this issue. Accordingly, this research aims to study the management of zakah by MAIWP from a juristic perspective, particularly its zakah distribution practices. This will include, inter alia, MAIWP’s redefinition of zakah recipients, various means of zakah distribution, companies and institutions that carry out assistance schemes on MAIWP’s behalf, and selected juristic issues concerning zakah distribution. The research has adopted a qualitative approach consisting of data collection and analysis from MAIWP’s website, MAIWP and PPZ’s annual reports, fatwa issued by various Islamic countries, as well as the writings of both classical and contemporary jurists. A semi-structured interview was also conducted with officials in the MAIWP’s relevant departments and academicians. The study revealed that MAIWP is the pioneering State Islamic Religious Council to establish PPZ, a corporation solely dedicated to zakah collection. Moreover, a significant portion of MAIWP’s zakah distribution in 2020 was carried out through assistance schemes such as welfare, economy, medicine, preaching and community development, protection, and education. The study found that it is permissible to delay zakah distribution for reasons such as benefit (maṣlaḥah) or necessity (ḍarurah), as well as to invest zakah, provided that the conditions stipulated by scholars are adhered to. In addition, the research also suggested a broadened understanding of tamiīk beyond individual ownership, allowing for collective ownership. It is hoped that this research will give a better understanding of the matter at hand and assist MAIWP and concerned authorities in improving and developing zakah administration in accordance with Islamic law.

    ABSTRACT The idea of the research is summarized in the fact that it deals with the defects of marriage in marital disputes and the role of family conciliation offices in addressing these marital disputes through reconciliation between spouses; due to the noticeable increase in the number of cases filed with the offices, there seems to be an urgent need to identify these issues that threaten the stability of marital life and the entire society, this study aims to clarify the truth about the defects of marriage and their sections for filing a divorce case for defects in the Bahrain Family Conciliation Office, and discuss defects that prevent the achievement of the legitimate objectives of marriage and those that do not prevent this, as well as ways and means to prove legitimate marriage defects and to identify the ways and means of proving the defects of marriage. This study will adopt the inductive approach by reading jurisprudence books and tracing the statements of jurists on issues related to family reconciliation and reconciliation, the analytical approach when citing and analyzing the texts of jurists, jurisprudence books, Bahraini family law books and the statements of specialized workers in family conciliation offices, and the field study through a semi-structured interview with relevant officials and experts in the field of Bahraini family law in family conciliation offices, where they will be asked specific questions to collect data on reconciliation and family reconciliation cases. The study concludes after referring to the important and prominent role of family conciliation offices in settling marital disputes and the extent of the effectiveness of these offices and their compatibility in achieving the purposes of marriage: That the defects of marriage are not limited to what was mentioned in the books of jurists in the past; and that there are new defects in our time, so everything that applies to the jurisprudential controls is considered an influential defect; among the recommendations are the most important ones: Developing a legal document that gives the guardian the right to expand medical examinations according to the need and interest, and obligating the employees of family reconciliation offices to conduct reconciliation attempts more than once and in several separate sessions.
