Abstract

This study aims to conceptualise disability and people with disabilities in Nigerian Disability Act 2018 in comparison to the provisions of Islamic law. It defines disability based on the perspectives of the people with disability themselves and maqasid al-shari'ah (the objectives of Shari'ah). This study examined disability provisions and persons with disabilities in Kwara State (Nigeria) by employing the inductive, analytical and comparative approaches. It searched for possible solutions to their problems. The Nigerian Disability Act 2018 is distinguished from the United Nations Convention on the Rights of Persons with Disabilities (2006). While the Convention on the Rights of Persons with Disabilities is largely a compilation and restatement of human rights found in other human rights documents, the Nigerian Disability Act 2018 is an anti-discrimination law for persons with disabilities. This study examined the expected benefits of the Nigerian Disability Act 2018 on persons with disabilities in the Kwara State, in particular, and in Nigeria in general. It recommends several actions, including: those concerned and officials must take into account the rights of the people by giving them what they deserve, and seek God’s pleasure in all conditions of the people and the country, whether the rights are for the disabled themselves or against them. It is also necessary to implement the Nigerian Disability Act 2018 as stipulated in the law as it will ensure the enforcement of the law later on. It also recommends that persons with disabilities be made aware of their rights under the law so that they can identify violations of these rights and seek redress for their rights.
