Abstract

This study seeks to examine jurisprudential pronouncements related to menstruation and puerperium and their relationship with modern medicine. Although menstruation and puerperium are frequently mentioned in the books of jurists, there are new scientific understandings related to women that require further research and study. The researcher explained the concept of menstruation and puerperium and related jurisprudence in brief, then outlined the methods and rules of jurists in devising judgments for jurisprudence in the field of menstruation and puerperium based on medical opinions, and concluded by clarifying the role of the Malaysian National Fatwa Council and jurisprudence on women’s health issues in light of modern scientific understanding. The research found that vaginal discharge invalidates ablution but does not promise impurity to get out of the body permanently, such as sweat and mucus, and if Shāriʿ makes these moistures unclean for people to fall in embarrassment. Moreover, the blood coming from an ectopic pregnancy is not puerperal but is istiḥāḍah because its origin is not from the uterus. It is the role of the Malaysian National Fatwa Council to conduct research and study of contemporary issues in various fields that require the views of the Shariʿāh and fatwa, including jurisprudential pronouncements related to menstruation
