Abstract

The purpose of this study is to analyze the development of a fundamental theoretical framework for studying the nature of Maqasid al shariah from the traditional sources; in addition to the application of Maqasid al shariah in dealing with the contemporary challenges that confront American Muslim family today. This study presents a comprehensive model and theory of the application of the objectives of Shariah through the American Muslim family. While all the previous studies focus only on the theoretical aspects of the objectives of Shariah, this paper actually applies the objectives of Shariah in the Muslim family system. The methodology of this study was obtained through an analytical method of collective data gathering. This study used both theoretical and practical aspects to formulate qualitative results. This study proved that the Structure of the objectives of shariah is An essential methodology in dealing with American Muslim family's challenges. This methodology opens great opportunities for Islamic law to address current challenges for Muslim societies and Muslim Minorities. Therefore, the study presents a strict set of rules which regulate the process of Ijtihad. This study also provides proposals that will positively impact and influence Islamic organizations in America. The conclusion of this study emphasizes on ability of applying the objectives of Shariah in the family law. This study proves that the objectives of Shariah protect the solidarity of Islamic rulings and emphasized the importance of a strict and organized process of Ijtihad.
