Abstract

This study aimed to identify the extent of effectiveness of Islamic Waqf System in the contemporary Islamic societies - including Dubai in the United Arab Emirates –, the methods of proffering solutions to its recession and the extent of satisfaction of Waqf parties. The study sheds light on the importance of the existence of institutional regulations to manage comprehensive quality and governance within the Waqf institutions. Being divided into theory and practical, the first part of the study addressed the concept of Waqf, its ruling, the rationale for its legitimacy, the institutional improvement of Awqaf and its history, and the laws and legislations governing it. Specifically, the study addressed the matter of comprehensive quality as well as the yardsticks adopted in the Institution of Endowments and Minor Affairs in Dubai and how it is governed in the light of Sharia principles. The study also addressed the relation of comprehensive quality and governance with the legislations of Waqf and its impact on the improvement of Waqf and its programs. The advent of Waqf quality as a concept, meaning: attracting the Waqif (Waqf provider) and managing the origins (through investment) through the methods of minimizing the expenses and efforts and a distribution of the yields on the eligible ones based on justice, all within a technical system dependent on continual evaluation and improvement with a view to earning a legitimate reward, reaching the satisfaction of Waqf parties and the society at large. In the practical aspect, the researcher conducted a field study on the Institution of Endowments and Minor Affairs through some interviews with prominent personnel of Waqf, including the overseers in the institution. The study employed inductive, descriptive, analytical and historical approaches as well as used an interview adopted to elicit information about the reality in the performance of the institution. The study concluded with a number of findings which are: The administrative and legislative stagnancy, and the corruption of responsible institutions have led to a decline in the demand for Waqf. Moreover, the improvement observed from the dawn of 1990s has been with respect to the function of Awqaf, methods of their management, the impact of supervision on the performance of institutions as well as the ways of attracting the endowers. There is inadequate Waqf education due to its restriction to the Masjid. The contemporary jurisprudential works have proffered solutions to the Waqf endowments in the institution.
