These psychological disorders hinder the realisation of the objectives of marriage when they exist in either spouse after marriage. In contemporary Bangladesh, the demand for judicial separation has become prevalent, particularly from wives, often due to mental illnesses. Notably, judicial separation initiated by wives constitutes 70% of all separation cases. Due to the lack of strict legal provisions in this matter, the husband�s rights in judicial separation are often compromised, leading to an increased number of separation requests from wives. This study aims to analyse the current legal framework concerning this issue in light of Maq??id al-Shar??a (the higher objectives of Islamic law) and to propose potential solutions. To accomplish this study, the researcher adopts the inductive methodology to collect data on this issue. Upon gathering the relevant information, the researcher will employ descriptive and analytical methods to present solutions to this problem in light of Maq??id al-Shar??a. Additionally, through field studies and personal interviews with scholars, Muslims, and medical professionals, the researcher will determine the rate, causes, effects, and solutions related to judicial separation in Bangladesh. One of the primary reasons for the increasing judicial separation due to mental illnesses is the widespread prevalence of psychological disorders in Bangladesh, the lack of strict legal measures, and the weak relationship between spouses due to unforeseen circumstances. The consequences of judicial separation are more severe than divorce initiated by the husband. Upon completing this study, it becomes evident that the current legal framework in Bangladesh regarding judicial separation does not fully align with Maq??id al-Shar??a in ensuring both spouses' rights to separation and lacks strict provisions in several aspects. Therefore, the researcher proposes the law to provide a more balanced legal approach that secures the rights of both spouses. Additionally, the researcher suggests several measures to reduce the rising rate of judicial separation and calls for a reconsideration of the existing legal framework regarding judicial separation due to mental illnesses in Bangladesh. Furthermore, the researcher recommends incorporating a legally recognised Islamic standard for medical examinations within the law, which would enable the court to accurately assess the presence and severity of mental illness in either spouse.
