Abstract
The purpose of this study is to address the Qatari family customs and the extent of their conformity with the objectives of Sahri’ah, by explaining the main aspects of bad family customs that negatively affect the spouses, and ways to deal with them. However, the serious consideration that is given to the norms in the society is undeniable. So, the researcher uses the following approaches: Inductive, descriptive, critical analysis and evaluative approaches. The researcher reviews the related literatures from the books of jurisprudence, fundamental and rules of jurisprudence. The research describes the said norms in order to determine the bad norms, and then analyze them for the purpose of evaluation and correction. Researcher focuses on five main family norms, which are: (1) Expensiveness of dowry in Qatar (2) The extent to which the fiancé is allowed to look at his fiancée (3) Consideration of compatibility in marriage (4) Depriving of own daughter from remarrying to her ex-husband (5) Depriving women from getting married. The research has revealed the contradiction between those norms and the three main objectives of Shar’ah which are the preservation of the religion, family and wealth. In conclusion, the researcher recommends that the Family Court, Family Counseling Center and Faculty of Shari’ah and Islamic Studies Qatar University should form a specialized committee to determine efficiency standards that are consistent with society's norms and customs.
